Terms of Service

These Terms of Service ("Terms") govern your use of the DeluxeFX mobile application ("App") and the website at deluxefx.co.uk ("Website"), operated by DeluxeFX ("we", "us", "our"), a company registered in England and Wales.

By downloading, installing, or using the App, or by accessing the Website, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm that you have your parent or guardian's consent to use the App and agree to these Terms.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions. You may not sublicense, sell, redistribute, or make the App available over a network where it could be used by multiple devices simultaneously.

3. Subscriptions and payments

3.1 Free and Pro tiers

The App offers both free and paid ("DeluxeFX Pro") features. Free users have access to core editing tools. Pro features are available through a paid subscription.

3.2 Subscription plans

DeluxeFX Pro is available as a monthly or annual auto-renewing subscription. Prices are displayed in the App and may vary by region. All prices include applicable taxes.

3.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

3.4 Managing your subscription

You can manage or cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until your current period expires.

3.5 Free trials

If we offer a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

3.6 Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted to Apple in accordance with their refund policy at support.apple.com. We do not process refunds directly.

3.7 Price changes

We may change subscription prices from time to time. Price increases will not affect your current billing period. Apple will notify you of any price changes before your next renewal, and you will have the opportunity to cancel.

4. Your content

You retain full ownership of all photos, videos, and other media you create, edit, or process using the App. We do not claim any rights, title, or interest in your content. All media processing happens locally on your device — your content is never uploaded to our servers.

The App, including its design, user interface, filters, LUTs, shaders, algorithms, logos, and all other proprietary components, is the intellectual property of DeluxeFX and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

7. Custom LUT imports

The App allows you to import custom LUT files. You are responsible for ensuring you have the right to use any LUT files you import. We are not responsible for any third-party LUT files or their contents.

8. Disclaimer of warranties

The App and Website are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

9. Limitation of liability

To the maximum extent permitted by applicable law, DeluxeFX and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business opportunities, arising from or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising from or related to these Terms or the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

10. Indemnification

You agree to indemnify, defend, and hold harmless DeluxeFX and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, if you breach these Terms. Upon termination, your license to use the App will immediately cease. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitations of liability) will survive.

12. Third-party services

The App is distributed through the Apple App Store and subscription payments are processed by Apple. Your use of the App Store is governed by Apple's terms and conditions. Apple is not responsible for the App or its content.

We use RevenueCat to manage subscriptions. RevenueCat processes subscription-related data on our behalf. See our Privacy Policy for details.

13. Apple-specific terms

These Terms are between you and DeluxeFX only, not with Apple. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for any claims relating to the App, including product liability, legal compliance, or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DeluxeFX regarding your use of the App and supersede any prior agreements.

17. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
